Effective 1 July 2024, Vietnam’s Ministry of Public Security has issued Decree 108/2026, a game‑changer for drivers whose licences have lapsed. If your car licence is overdue by less than 30 days, you can now renew it without sitting the theory exam again.
What the new rule covers
The decree amends Article 19, clause 2, point a, stating that any holder of a Category B, C, D, or E vehicle licence whose expiration date is less than 30 days past does not need to retake the theoretical part of the driving test.
Who still has to take the theory test?
- 30 days to 1 year overdue: Drivers must sit the theory exam before a new licence can be issued.
- One year or more overdue: Both theory and practical (closed‑track and road) exams are required.
Special exemptions
The Ministry also recalls the earlier Decree 12/2025, which granted a temporary waiver for licences expired under one month when renewal is impossible due to illness, natural disasters, fire, or epidemic conditions.
How fast can you get the new licence?
Under Decree 108/2026, electronic licences are generated and uploaded to the national database within 2 hours after the renewal test is completed. For those who still prefer a physical PET (polyethylene terephthalate) card, the traffic police department will print and deliver it within 3.5 working days.
Steps to renew without a theory test
- Gather your expired licence (less than 30 days overdue) and a valid ID.
- Submit a complete renewal application at a local traffic police office or via the official online portal.
- Pay the renewal fee and have your biometric data recorded.
- Receive your electronic licence instantly, or pick up the PET card within a few days.
When does the rule take effect?
The decree was signed on 29 June 2024 and became legally binding on 1 July 2024. From that date forward, any qualifying driver can enjoy a smoother, faster licence renewal process.
